Public Policy TERMS & CONDITIONS

Health Education Arts And Research Trust , registered public charitable trust, (hereinafter referred to as “HEART NGO”) owns, operates and manages the website, https://www.heartngo.org (hereinafter referred to as “Site”). The terms of use (hereinafter referred to as “Terms of Use”) and the Privacy Policy (defined herein below) herein shall govern the use of the Site. Your access or use of the Site signifies that you (hereinafter referred to as “User”) agree to be bound by these Terms of Use and the Privacy Policy. HEART NGO reserves the rights to revise the Terms of Use and Privacy Policy from time to time, at its absolute discretion, without notice, and such revisions shall be binding on the User. If the User disagrees with any part of these terms and conditions, please do not use our Site.

(1) Use of Site and Site Material

The User is authorized to access and use the content available on the Site (the “Site Material”), subject to the following conditions:

(i) The Site Material may be used by the User only for non-commercial and personal purposes;

(ii) Neither HEART NGO nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this Website for any particular purpose. The User acknowledges that such information and materials may contain inaccuracies or errors and HEART NGO expressly excludes liability for any such inaccuracies or errors to the fullest extent permitted by law.

(iii) The Site and Site Material shall not be reproduced, duplicated, copied, sold, resold, or otherwise exploited for any commercial purpose whatsoever by the User without the express written consent of HEART NGO;

(iv) Any Site Material copied, downloaded or / and printed by the User for personal purposes shall not be modified in any manner whatsoever, and is used entirely at the User’s risk;

(v)From time to time, the Site may also include links to other websites. These links are provided for your convenience and enhance usability. By accessing the Site the User hereby waives any claim the User might have against the HEART NGO with respect to such linked websites and third party Site Material. These links do not signify that HEART NGO endorses the website(s) or have any responsibility for the content or functioning of the linked website(s) and HEART NGO shall not be held responsible by the User for any claim or loss occurred or that may occur to the User arising out of such linked websites and third party Site Material;

(vi)HEART NGO shall not be held liable in respect of any claim or loss that occurs or may occur to the User or any third party arising out of the User’s Usage of the Site and Site Material.

(2) Use of HEART NGO’s Trademarks

The User shall seek the prior written consent of HEART NGO before using HEART NGO’s trademarks, include, but not limited to: (i) https://www.heartngo.org, Health Education Arts And Research Trust and HEART NGO.

The Site may occasionally use intellectual property belonging to third parties engaged with HEART NGO including but not limited to any copyrighted material, trademarks, service marks, and trade dress on the Site (hereinafter referred to as “Third Party Intellectual Property”). Notwithstanding anything contained herein, the relevant third party retains ownership of all such Third Party Intellectual Property. Nothing contained on this Site shall be construed as a license to use such Third Party Intellectual Property. HEART NGO shall not be held liable towards any third party for any damages, loss or claim due to any infringement of Third Party Intellectual Property arising out of the User’s use of such Third Party Intellectual Property.

Submissions and Services

The User may upload information or data of any nature whatsoever on the Site subject to the following conditions:

(a) By posting or submitting any information on the Site (hereinafter referred to as “Submissions”), the User hereby grants to HEART NGO a worldwide, royalty-free, non-exclusive, transferable, sub-licensable, perpetual license to cache, copy, distribute, modify, adapt, publish, translate, transmit, publicly perform, reproduce, revise and otherwise use the User’s Submissions to the Site.

(b) The User agrees that HEART NGO has the right to publish the User’s name in connection with the User’s Submissions.

(c) The User may request the removal of the User’s Submissions for any reason on reasonable written notice to HEART NGO, on receipt of which HEART NGO shall take steps to remove such Submissions.

(d) By making Submissions on the Site, the User agrees to indemnify and hold HEART NGO or any person acting on behalf of HEART NGO harmless for any and all claims, damages, losses including for loss of reputation whatsoever that HEART NGO may incur or suffer due to the User’s Submissions.

HEART NGO is under no obligation to use the User’s Submissions and HEART NGO may at its sole discretion remove any Submissions from the Site at any time, without intimating the User who’s Submissions are being removed.

The Site may require the User to create a user profile before making a Submission or before using any of HEART NGO’s services on the Site. The User agrees and undertakes to provide accurate and complete information and update his/her user profile as and when required by HEART NGO.

The following acts are prohibited when making Submissions on the Site or Using the HEART NGO’s services on the Site. Committing such acts may, at the discretion of HEART NGO, result in termination of the User’s use of the Site:

1. a) Harassing or threatening other Site user(s) of the Site;
2. b) Sending any Submission that the Site believes to be unauthorized, false, inaccurate, misleading, deceptive, fraudulent, libelous, defamatory, immoral, offensive, obscene, pornographic, disruptive, threatening, abusive or illegal;
3. c) Distributing viruses or other malware using the Site;
4. d) Harvesting user information from the Site without the users’ or/and HEART NGO’s permission;
5. e) Impersonating any Site official or representative or any person acting on behalf of the Site or HEART NGO;
6. f) Distributing unsolicited advertising or promotional materials using the Site;Any violations of the aforesaid conditions may be reported to heart@heartngo.org.

(3) Disclaimer of Warranty and Limitation of Liability

Neither the Site, HEART NGO nor any of its agents, or any other party involved in creating, producing, or delivering the Site is liable for any direct, incidental, consequential, indirect, or punitive damages or claims or losses arising out of the User’s access to, or use of, the Site or the Site Material.

(4) Cookies

The Site may place a cookie on the User’s computer. A cookie is a small text file that a website places on the User’s hard drive. Its purpose is to let the Site know when the User visits the Site and to perform certain functions including but not limited to saving passwords, personal preferences, etc. Usage of a cookie is in no way linked to the User’s Personally Identifiable Information while accessing the Site. Once the User closes his/her browser, the cookie shall automatically terminate. Further, third parties engaged with HEART NGO including but not limited to non-governmental organizations engaged with HEART NGO, sponsors etc., may use cookies on the Site. HEART NGO does not, however, have any access to or control over cookies used by such third parties.

(5) Children under 13 years of age

HEART NGO shall not collect personal information from children under the age of 13. Personal information collected from children under the age of 13, without the child’s parents or guardians consent, shall be deleted from the Site once HEART NGO comes to notice of such information.

Without limiting the foregoing, the Site and Site Material are provided “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

(6) Applicable Law

The Terms of Use herein shall be construed in accordance with and be governed by the laws of India. All disputes arising out of relating to the Terms of Use shall be subject to the exclusive jurisdiction of the Courts in Chennai.
